This policy paper written by Anthea McIntyre MEP sets out how the Annual Burden Survey could be used to draw comparisons, on an annual basis, on the way individual pieces of legislation have been transposed at the national level by each Member State. It
It could also identify additional or new elements that have been added to the legislation. While Member States are always free to set higher standards, in many cases the additional bureaucracy added to legislation during transposition is not related to the original aims of the legislation or is not necessary.
The ABS as set out in this policy paper will in essence help identify cases of unnecessary gold-plating in Member States. Ms McIntyre believes that by bringing such transparency to the legislative process for our citizens and businesses, we can ensure that legislation remains simple, clear and enforceable.
